Terms of Use

These terms of use (the “Terms”) govern access to and use of the La Bonne Cueillette mobile app and website (the “Service”), published by the company identified in the legal notice (the “Publisher”). By creating an account or using the Service, the user fully accepts these Terms.

1. Purpose

The Service is a short-supply-chain marketplace connecting shoppers with local producers to make it easier to discover, order and collect products.

These Terms set out the conditions for accessing and using the Service. They apply to every user, whether a shopper or a producer.

2. Definitions

In these Terms, the following terms have the meaning below:

  • “User”: any person who accesses the Service.
  • “Shopper”: a user who browses, orders or collects products.
  • “Producer”: a professional offering their products for sale via the Service.
  • “Account”: the personal space giving access to the Service's features.
  • “Content”: any information published by a user (listings, products, reviews, messages, photos).

3. Acceptance and changes to the Terms

Using the Service constitutes full acceptance of the Terms in force. A user who does not accept the Terms must stop using the Service.

The Publisher may amend the Terms at any time. Users are informed of material changes by any useful means. Continued use after new Terms take effect constitutes acceptance.

4. Access to the Service and registration

The Service is free to access, excluding connection and equipment costs borne by the user. Some features require creating an account.

The user agrees to provide accurate, complete and up-to-date information when registering and to keep it current. Registration is reserved for adults or those with their legal representative's authorisation.

5. Account, credentials and security

The user is responsible for the confidentiality of their credentials and for any activity carried out from their account. They agree to notify the Publisher without delay of any unauthorised use.

The Publisher cannot be held liable for the consequences of any disclosure, intentional or not, of the user's credentials.

6. The platform's intermediary role

La Bonne Cueillette acts as a technical intermediary connecting shoppers and producers. Sales contracts are concluded directly and exclusively between the shopper and the producer.

The Publisher is not a party to those sales contracts, is neither seller, reseller nor owner of the products, and does not take part in their production, storage or handover.

7. Shopper commitments

The shopper agrees to:

  • use the Service in good faith and for its intended purpose;
  • honour the orders placed and show up for pickup within the agreed slots;
  • publish only lawful, accurate and respectful content (reviews, messages);
  • not infringe the rights of producers or third parties.

8. Producer commitments

The producer acts as a professional. They are solely responsible for their products, listings and sales. In particular, they agree to:

  • comply with the regulations applicable to their activity (hygiene, food safety, traceability, labelling, metrology);
  • provide accurate information about their products, prices, availability and pickup conditions;
  • hold the authorisations, declarations and insurance required for their activity;
  • honour accepted orders and ensure the quality and conformity of the products handed over;
  • comply with consumer-law obligations towards shoppers.

9. Content and intellectual property

The trademarks, logos, texts, interfaces and elements of the Service are protected by intellectual property law and remain the property of the Publisher or its partners. Any unauthorised reproduction is prohibited.

By publishing Content, the user warrants they hold the rights to it and grants the Publisher a non-exclusive licence to use it for operating and promoting the Service. The Publisher may remove any unlawful Content or Content that breaches the Terms.

10. Personal data

The processing of personal data is described in the Privacy Policy, which forms an integral part of these Terms.

11. Availability, maintenance and changes

The Publisher strives to keep the Service available but cannot guarantee continuous, uninterrupted access. It may suspend access for maintenance, updates or security reasons.

The Publisher may change the Service's features at any time.

12. Liability

The Publisher provides the Service “as is”. It cannot be held liable for disputes regarding product quality, availability, conformity or pickup, which fall solely within the shopper–producer relationship.

The Publisher cannot be held liable for indirect damages, nor for the consequences of force majeure or of an act attributable to the user or a third party.

13. Suspension and termination

In case of breach of these Terms, the Publisher may, after formal notice that has remained ineffective where applicable, suspend or terminate access to the relevant account.

The user may stop using the Service at any time and request deletion of their account (see the “Account deletion” page).

14. Governing law and disputes

These Terms are governed by French law. In case of dispute, and failing an amicable resolution, the French courts have jurisdiction, subject to mandatory consumer-protection rules.
